32(f) The Student Disciplinary Investigation Officer Team is responsible for and authorised to: (j) Investigate and gather facts of the case; (ii) Summon and obtain statements from all relevant parties; (iii) Collect and secure evidence related to the case; (iv) Prepare an investigation report to be presented to the USDC.(g) The authority of the USDC is as follows: (i) Upon receiving the investigation report, the USDC must determine if there is a prima facie against the student and sufficient evidence to proceed with a hearing; (ii) Conduct hearing procedures for serious offences (Category A %u2013 Schedule IV) or moderately serious offences (Category B %u2013 Schedule III); (iii) Has the authority to determine any conduct that is deemed an offence according to the regulations. (iv) Decide on the charges; (v) Determine the appropriate punishment.(h) All disciplinary hearings must be attended by a USDC quorum, with each member having the right to vote. Observers do not have the right to vote, or make any statements, or provide opinions during the hearing.54. NOTICE OF HEARING(a) If the USDC finds that there is a prima facie case, the accused shall be called in writing to attend the disciplinary hearing on a date and time determined by the USDC.(b) The notice to attend the hearing must be sent to the accused no less than seven (7) working days before the disciplinary hearing, detailing all charges.(c) If the accused fails to attend the disciplinary hearing as required under sub-clause 55(a) above, they may be charged with offence K03 and fined RM300 for the absence.
